Terms and Conditions of Use
Below are set out the terms and conditions of use that a user (you) accepts upon registering at, and upon using at any moment, EngWish.com. These terms and conditions are subject to change at any moment and it is the responsibility of the user (you) to remain informed as to any such changes.
FREE VIP MEMBERSHIP
Free VIP Membership for a period of 30 days is currently included with every purchase of Beginner to Advanced English. This VIP period can be started by the user at the user's own preferred time. There is no expiry date for claiming this free offer.
RENEWAL OF MEMBERSHIP
VIP Membership will never renew itself automatically and requires manual intervention in order to be extended. This is to provide users with total transparency and a no-obligation style service. Membership can be renewed or extended for a minimum of one month per purchase and can be done so at any time — only with the user's full authorisation and only at the user's specific request.
EngWish.com teachers will provide additional services to all VIP Membership users in accordance with a policy of "fair usage". This means that services, such as grammar explanations and one-to-one chat, will be provided to the point that the teacher deems appropriate. If a student abuses such services in an attempt to gain an exessive amount of support in a manner that is deemed to be abusive or inappropropriate, the teacher reserves the right to not provide any further correspondence regarding that particular point or course topic. Those users with lifetime VIP Membership can receive unlimited service of all non-teacher-dependent functionality such as the creation of forum topics and certificate activation; however, the duration of other services that are dependent on teacher participation, such as homework correction and chat, are unlimited to the point of 100% course completion.
All users of EngWish.com must be 16 years old or more or must have the full consent of a parent or guardian to use EngWish.com. Users below the age of 16 also require the continuous guidance and supervision of a parent or guardian who is aged 18 or older. By creating and using an EngWish.com account, the user declares that he or she is fully aware of these age restrictions and respects such conditions. The user accepts the full responsibility that this criteria has been met at all times when using EngWish.com.
PROTECTION OF DATA
Users' personal details, such as e-mail addresses and any other information provided, are never shared with any third-parties. EngWish.com may periodically send users e-mail notifications to inform them about free activities for practising English, such as those available within the public forum. E-mail notifications, however, can be deactivated easily at any time within the Settings area once signed in.
The correction and assessment of homework and exams (coursework) by a course teacher is not subject to any particular time limit: the teacher correcting a user's work has the right to take the required time in order to perform the work as deemed necessary by the teacher. Homework and exams for correction that are submitted by all users are subject to a system of queuing. Users' work will be corrected on a first-come-first-served basis and on the condition that the correction of any previous coursework has been first conducted by course teachers. A general guide is that coursework is corrected and returned to students in under 48 hours - excluding weekends (Saturday and Sunday); however, these times may vary and correction times can sometimes be more or less than that what is typical. In particular, during busy times, a user's introductory exam (Welcome to EngWish) assessment may require up to 1 week for assessment to be completed and for acceptance onto the platform.
Following a user's initial level assessment, a new exam response may be submitted for correction and level reassmessment once every 20 days. This is to ensure that the user has taken the necessary steps and learning measures outlined by the professor in the previous assessment have been applied. New homework, however, may be submitted immediately as soon as previous homework has been assessed.
Error explanations can be provided for all changes to the user's English in coursework submissions. By default, all changes to the user's English in exams are explained in detail without request by the user. However, for explanations of changes to the user's English in homework submissions, for individual lessons, the user should request such explanations explicitly after first receiving the correction from the teacher.
When submitting coursework, the user should respect the stated word limit and/or sentence limit. In exam submissions, the word limit is stated below the submission input area. In homework submissions, more flexibility is afforded to the user and no word limit is typically implemented. However, any sentence limit or task limit stated in the lesson (in the course book) should be respected by the user when submitting homework for assessment. Failure to respect such limitations can result in the teacher marking excess sentences as errors.
Users' first names, profile picture, age, country, location and English level are made public within the EngWish forum when users engage with topics. Users' profile information will never be sold nor passed to any third-parties. Users' surnames are required specifically for the use of users' course certificates and are visible only to those people with whom users decide to share their certificates.
FIRST NAME CHANGES
A user's first name cannot be modified after 30 days following account registration. This is due to fraudulent activity prevention. First name changes after this 30-day period can only be made by EngWish administration when requested manually by the user via e-mail and when a valid reason is provided.
DECENCY AND APPROPIRATENESS
Profile pictures, names and other public information uploaded by users should not contain any inappropriate imagery or content. Inappropriate is deemed as pornographic, extremely violent, or hate-related content. Users who breech this condition will be subject to immediate termination of service without warning and, in extreme cases, may be reported to the police or necessary authorities.
PROTECTION OF DATA
Textual data submitted for proofreading will never be made intentionally visible to the public by EngWish.com. EngWish.com takes various security measures in order to safeguard the privacy of its users; however, should these safeguards fail, due to security breech or malfunction for example, EngWish.com nor any of its teachers can be held accountable for the damages caused by the leaking, loss of or exposure of any sensitive data that was submitted for text correction.
When using Teacher Chat from a web browser, each credit can be used to record voice (with compatible browsers) or to send a text message. Students should test their browsers for recording and text compatibility using their free credits before purchasing additional credits. Internal conversation flow (within EngWish.com) is then based on student and teacher availability and the teacher will attempt to respond to student messages (voice or text) as soon as possible, typically in under a few hours. On some occasions, the teacher may be able to respond directly to student messages and even speak with a student at length; however, should students not receive a response immediately, patience is required and students should return frequently to check for a response and continue the conversation — much like when chatting with friends in WhatsApp or Viber.
HOURS OF SERVICE
Teacher Chat is available between the hours of 08:00 and 20:00 London Time, Monday to Friday. However, the response from the teacher will vary depending on the teacher's schedule. In some cases, a response from the teacher may arrive outside the hours of service.'
The user is eligible for a diploma certificate stating the user's English level upon completing an assessment exam and a minimum of 5% of coursework, which can be either homework or assessment exams, or a combination of both.
TERMINATION OF ACCOUNT
EngWish.com reserves the right to terminate all user accounts that are deemed to be duplicate accounts of the same individual or same IP address. It is strictly forbidden to create multiple accounts with the intention of manipulating any of the safeguarding security measures at EngWish.com that can be found in any of its services. Loss of VIP Membership or any other paid service due to such misconduct will not be eligible for refund. In addition, any user who conducts himself or herself inappropriately while interacting with a member of EngWish.com staff will be subject to permanent account termination. Inappropriate conduct is regarded as the use of potentially offensive or inappropriate language and/or the use/displaying of any inappropriate imagery.
HOURS OF SERVICE
EngWish.com operates on London Time, i.e. Greenwich Mean Time. EngWish.com, the online service, is accessible twenty-four hours a day, seven days a week, providing there are no technical errors beyond the control of EngWish.com, such as server or website code malfunction, or server downtime. During active service, a native English teacher will be available to provide his or her services periodically throughout the entire day from Monday to Friday. When a teacher is not online, the website, its services, and the ability to submit coursework will still remain fully functional.
TERMINATION OF SERVICE
EngWish.com reserves the right to terminate or suspend service of any user who is found to be demonstrating inappropriate conduct. Inappropriate conduct is deemed as the displaying of inappropriate profile data or the publishing of offensive textual data. EngWish.com also reserves the right to terminate or suspend service of any user who is found to be manipulating and abusing the account registration system in order to manipulate and bypass learner restrictions. Loss of service, including paid services, will not be reimbursed financially in any way to any user who has his or her account terminated as a result of misconduct.
Refunds for all goods purchased via EngWish.com will be considered if requested within 14 days of ownership. In the case of digital goods and services being to the user's dissatisfaction, once delivered, in an attempt to prevent buyer fraud and abuse, a reduced refund of 50% of the initial payment will be available within 7 days from the date of ownership. This is in exchange for the product or service delivered, which is typically non-returnable due to its digital and intangible nature. Exceptions to this rule may be if the item or service is in some way faulty in which case a replacement or revision can be negotiated. For physical goods, refunds will be considered if requested within 14 days of ownership and negotiated on a case-by-case basis due to the possible complexities involved in international shipping. Faulty physical goods are eligible for a refund if requested within 30 days from the date of ownership. Refunds for both digital and physical goods should be requested manually by e-mail at email@example.com.
For physical goods that are returned, the user (buyer) will be responsible for any postage costs that are incurred. For all returned goods, tracked postage must be used and a reference code and/or a photograph of postage receipt must be supplied. Returned goods will only be accepted as eligible for a refund if the goods returned are deemed to be undamaged and in the same condition in which they were sent to the user.
When ordering physical goods, it is the user's sole responsibility to provide a correct delivery address. In the event of goods not being delivered as the result of a user providing an invalid address, the user will not be eligible for a monetary refund nor a reshipment of goods.
In the event of physical goods not arriving, the user should allow 10 working days from the date of dispatch in the UK, or 30 working days from the date of dispatch outside of the UK, in order for an order to be deemed and reported lost.
